The U.S. Constitution has long protected parents' rights to direct the upbringing and education of their children as fundamental rights. The U.S. Supreme Court and other federal courts have consistently recognized that parents have the right and duty to direct the care and upbringing of their children. However, they have not always treated parental rights as co-equal to other fundamental rights--like free speech or the free exercise of religion. As a result, some courts treat parental rights as a "second-tier" right and do not properly safeguard these rights against government infringement.
The Families' Rights and Responsibilities Act remedies this problem by restoring parental rights to a "top-tier" right for purposes of federal law. It gives families a fair hearing in court when the federal government enforces any policy against parents in a way that undermines their right and responsibility to raise, educate, and care for their children. The Families' Rights and Responsibilities Act is a restriction on the operation of the federal government. It limits the federal government from interfering with parental rights and requires federal officials to satisfy the strict scrutiny standard to justify any infringement upon that right.
My Faith Votes, along with over 40 organizations, is working at all levels of government to protect every parent's right to make decisions regarding their child's education and health care. This coalition called Promise to America's Parents sent a letter to House and Senate leadership urging congress to pass the Families' Rights and Responsibilities Act (FRRA). This Act was introduced in the House H.R.6934 and Senate S.3571 in January 2024. Send a message to your elected officials to enact this legislation today.
